Josefine Weekey: Your a smart lady, you know that had he a leg to stand on he would have had you evicted. Now all you are waiting for is the real landlord to come and evict you. But, you can make an offer to purchase the home from the bank on foreclosure if you get to the bank early on.
Jackelyn Archut: The bank took over ownership. From what I could get at the town hall there is 6 leans on the property, and he has not paid mortage in over 2 years. So I am guessing that is the reason for forclosure. The house has 3 apartments all of which are rented. They were all rented in the last few months. I have only been here for 3 months almost 4. I have not recieved any kind of documents from the bank nor has anyone else here. I went to the town hall just to check on things cause stories were not adding up it alot of what he was saying sounded suspicious, glad I went with my gut and checked into it.! Arleen Bussing: Ask him by what right he is collecting rents? So what prompted you to look into this at the town hall? Something must have and I suspect it was a document placed on your door when it was foreclosed upon. You are VERY smart to put that rent aside.Don't be stupid and spend it either or you will find yourself homeless. Just because it was foreclosed on does NOT mean you getto live there scott free.I would call the bank and make sure they know you are there and want to stay there before getting a 3 day notice to get out. They do eventually look at their portfolios and this will come back to haunt you."was taken into their possession"Whose is "their"?Added: I just thought of something and that is that under many state laws you have a certain amount of time to redeem a foreclosed house and during that period I suspect he could collect rents. Your question is not clear on if it was a tax f! oreclosure or a mortgage foreclosure. If it is in redemption ! period you better pay that rent or get ready to be evicted. Antonia Boomershine: I seriously do not know how this has gone unnoticed by the bank and even the town. What he is doing is illegal and so is what you are doing by living there. Because a lease can not be written on a property that doesn't belong to him, you are not entitled to anything because there is no legal landlord/tenant relationship.You need to move immediately before you are charged with trespassing by the bank....Show more
